Did the doctor make a mistake that a reasonable doctor under the same circumstances would not have made? To prove this you may need the testimony of another doctor or good expert witness.
Did the mistake the doctor make cause injury to you? This means you have to prove that if the doctor had not made the mistake then you would not have been injured.
How much damage did you suffer as a result of the injury? This could include lost wages, medical bills, pain and suffering or death. Testimony from an economist might be needed to assess the full amount of damages.
