Have you been the victim of whiplash? Are you trying to decide whether to file a personal injury claim because of whiplash you received in an accident.

Sadly, when some people hear the word whiplash, they think of someone who is trying to fake an injury or scam an insurance company. Or, they think whiplash is something that is not very serious. They think whiplash is something that you get over in a few days.

Millions each year

The truth of the matter is that millions of people suffer whiplash each year in the United States. While a small number of these people do try to take advantage of a whiplash personal injury claim, there are a far greater number of people who truly deserve being compensated for whiplash.

One thing that many people do not realize is that whiplash can be caused by a minor accident. It does not have to be a major accident for whiplash to occur. For example, being in a car that is hit in the rear by another car may not cause serious damage to either car, but it may cause you to experience whiplash.

Most people associate whiplash with a car accident. However, whiplash may be caused by several other things. Among these are:

Repetitive stress injuries at work
Slip and fall accidents in homes, stores or sidewalks that are not well-maintained
Snowboarding and skiing accidents
Participation in contact sports
Truck and car accidents that are not rear-end impact
Child abuse, such as shaken baby syndrome
An intentional assault that results in head trauma.

Whiplash can range anywhere from mild to severe. Whiplash may only require you to wear a neck brace for a short period of time. However, whiplash can also involve paralysis. If whiplash is not promptly treated, it may grow progressively worse and result in long-term physical therapy and surgery.

There are several signs and symptoms that you may have with whiplash. Some of these are:

Neck pain and stiffness
Headache
Not being able to move your neck
Arm, shoulder or back pain
Unusual sensations, such as prickling, tingling or burning in your arms
Dizziness
Decreased range of motion
Fatigue, difficulty concentrating or disturbance of your sleep
Blurred vision.

If you are thinking about filing a personal injury claim for whiplash, you should know that most personal injury attorneys do not like to use the word whiplash because of the negative connotations that it brings to the minds of many people. It is better to use more technical names, such as cervical or neck sprain or strain, myofascial injury or hyperflexion/hyperextension injury.

You should also understand that in order to win a personal injury claim for whiplash, it must be proved that you did not cause the accident, and you will have to prove negligence on the part of the person who did cause the accident.

The best thing to do is to sit down with a personal injury attorney and let him or her assess your case and advise you as to whether it would be in your best interests to pursue a personal injury claim for whiplash.

Have you suffered an injury from a broken stairway? Do you realize that you may be entitled to file a claim?

Stairways are necessary inside and outside of buildings that have more than one floor. Even though elevators are wonderful, there are times when they cannot be used for one reason or another. At other times, you may simply want or have to take the stairs.

Serious injury

You may use a stairway so often that you are not prepared for loose handrails, irregular steps, broken stairs or other difficulties that may result in a fall. Falling on a broken stairway can bring about a serious and/or severe injury. This may include:

Head injury
Broken bones
Other kinds of trauma.

One of the problems with a broken stairway is that it is often not obvious or otherwise easily visible. Things like ice or snow may prevent you from seeing a broken stairway on the outside of a building. Poor or inadequate lighting or carpet or other covering may keep you from noticing a broken stairway on the inside of a building.

Did your fall down a broken stairway cause serious injury? Are you wondering whether you can be compensated for your injury? Would you like to know if you have a claim against the owner because of your injury?

Things to consider

There are several things to consider before filing a claim against the owner of the building where you suffered a broken stairway injury. Some of these are:

How serious is your injury? If you only received some minor bumps and bruises, you probably do not have a claim against the building owner. However, if your injury involves things such as, a broken bone, concussion or other head or brain injury, you may certainly want to consider pursuing a lawsuit against the owner of the building.

The age of the stairs.

The design of the stairs

Has age caused the surface of the stairs to become slick

Lighting was poor or inadequate.

If you decide to pursue a claim against the building owner, it falls in a category of law that is referred to as premise liability. Premise liability is law where a person who is the owner of a building or land may be held responsible for some types of injuries that a person suffers who is there in the building or on the land.

A premise liability lawsuit is a type of lawsuit in which you seek to prove that a property owner was negligent, and their negligence was what caused your injury. In this instance, you would be seeking to prove that the building owner was negligent in his care and upkeep of the stairway. Due to his negligence, there was a broken stairway which resulted in you falling and being injured.

The best thing to do is to get in touch with a personal injury lawyer who will discuss and evaluate your case with you. A personal injury lawyer will help determine whether you have a strong premise liability case. A person injury lawyer will advise you as to whether a premise liability lawsuit against the owner of the building is the best option to pursue.

A sidewalk is a wonderful thing that can make walking so much easier. A sidewalk can provide much better “footing” and help prevent slips, trips and falls.

However, a sidewalk may become cracked and uneven. Then, instead of preventing slips and falls, it may become the cause of a slip and fall accident.

Causes of an uneven sidewalk

There are two main causes of a sidewalk becoming uneven. The first is the result of tree roots pushing up through the concrete pavement. The second main cause of an uneven sidewalk is the concrete pavement becoming sunken as a result of material warping or an unstable base.

You may have fallen and received an injury on an uneven sidewalk. The thing you would like to know is, “Am I able to file a personal injury claim as the result of falling and sustaining an injury on an uneven sidewalk?”

When you fall on an uneven sidewalk, this injury comes under the heading of what is called a “slip and fall”. You can slip and fall almost anywhere and for a variety of reasons.

Why did you slip and fall

If you slip and fall on an uneven sidewalk because of your own carelessness or not paying attention to where you were going, you really do not have a claim and will have to bear the consequences and costs of your injury, yourself. However, if your slip and fall on an uneven sidewalk was due to some degree of negligence on the part of the owner of the property, you may be able to file a “slip and fall” claim. A slip and fall claim comes under the heading of what is known as a premise liability lawsuit.

Premise liability law is a body of law in which a person who is the owner of premises or land is liable for certain kinds of injuries that happen to a person who is there on the land or premises. Premise liability laws vary from state to state.

Premise liability cases that involve a slip and fall on an uneven sidewalk are not easy to prove. This is because it is necessary to prove that the property owner either unreasonably permitted a dangerous condition to continue that he should or could have fixed, or the property owner was responsible for creating the dangerous condition.

Not automatically liable

It is essential that you understand that a premise or land owner is not automatically liable simply because you slip and fall on their premises or land. It is necessary for you to prove that the owner should have seen the condition, recognized the danger and did something about it. However, a court may say, “If the condition of an uneven sidewalk was open and obviously dangerous to the owner of the land, it should have been open and obviously dangerous to you, also. In which case, you should have seen the condition and avoided it.

For these reasons, among others, it is always wise to consult a personal injury lawyer to have him or her determine the merits of your case and whether it would be a good idea to file a premise liability claim for your slip and fall on an uneven sidewalk.

Most people do not realize how large a health problem obesity and being overweight are in the United States. According to the Centers for Disease Control and Prevention, 67% of Americans who are age 20 and above are either overweight or obese. That represents two out of every three Americans.

There are several ways that Americans try and deal with this problem of being obese or overweight. These include dieting, pills, purging, fasting, exercise and surgery.

Bariatric surgery

There are many kinds of weight-loss surgery that are referred to as bariatric surgery. One of the most common forms of bariatric surgery in the United States isgastric bypass.

Gastric bypass is a type of surgery that enables you to lose weight by changing the way in which your small intestine and stomach take care of the food that you eat. Your stomach is made smaller by gastric bypass. This means that it will not take as much food to cause you to feel full.

Another result of gastric bypass is that food will no longer travel into certain areas of your stomach and small intestine that break down food. As a result, your body does not absorb all of the calories from the food that you eat.

Dangerous surgery

This sounds like a great solution if you are morbidly obese or overweight, and dieting and exercise has failed. However, gastric bypass should be your last resort, not the first thing that you try when you are overweight. The reason for this is because the surgery is dangerous and has many possible complications. Some of these include:

Post operative leaks

Acute Gastritis (which leads to other symptoms)

Respiratory arrest

Metabolic bone disease

Osteoporosis

Internal hemorrhaging

Abdominal infection or hernia

Heart problems

Death

You may have had gastric bypass surgery. Are you experiencing any of the possible complications that have just been mentioned? Are you experiencing other complications as a result of gastric bypass?

Did your surgeon take the time to fully explain to you the many complications and risks that were possible with this kind of surgery? Did your doctor fulfill his duty to work closely with you before and after gastric bypass surgery to be alert for any possible complications and to make sure that you received all of the benefits that you should have from the surgery.

Have you considered filing a gastric bypass malpractice claim? A personal injury attorney can evaluate your case and advise you about the merits of filing a malpractice claim.

There are several things that may indicate that it would be a good idea to file a gastric bypass malpractice claim. Some of these are:

Failure to diagnose or properly treat the leakage of gastric fluid
Failure to follow-up with and properly monitor you
Failure to diagnose and properly treat gastric bleed
Performing the surgery improperly
You were not a proper candidate for this type of surgery
Failure to recognize and act on complications
Inexperience of the surgeon who did the surgery
You were not fully informed of the risks of the surgery.

Once again, a personal injury attorney will discuss your case with you and advise you of the best way to proceed.

Cerebral palsy is a general term that is used in reference to a group of disorders that start during the early stages of life. Cerebral palsy affects the ability of your child to coordinate body movements.

These disorders result from damage to the brain of your child, early during the course of development. This damage can take place during fetal development, the birth process or the first few months after the birth of your child. Cerebral palsy is a disorder that may range anywhere from mild to severe.

There are three main kinds of cerebral palsy:

Spastic cerebral palsy is what most children have. This kind of cerebral palsy causes muscles to stiffen making movement difficult.

Athetotic cerebral palsy is what about one in five people with cerebral palsy have. It is also referred to as extrapyramidal cerebral palsy. It affects all of the body and usually causes slow, uncontrolled movement.

Ataxic cerebral palsy is the rarest form of cerebral palsy. It affects coordination and balance.

Cerebral palsy results from an injury to or an abnormality in the cerebrum. The cerebrum is the largest part of the brain. It is the area of the brain that controls voluntary motor sensation and function. Cerebral palsy affects movement, but the underlying problem is in the brain, not the muscles.

The cause of cerebral palsy cannot always be identified. However, hypoxia (oxygen deprivation) to the brain is the thing that is most responsible for a child getting cerebral palsy. This is hypoxia that takes place during labor and delivery.

Oxygen deprivation may occur as a result of things that are not medically preventable. On the other hand, your child’s cerebral palsy may have come about because of medical malpractice during your labor and delivery.

Medical malpractice

Medical malpractice is professional negligence as shown by an act or omission on the part of a health care provider. Medical malpractice is treatment that falls below the accepted standard of practice in the medical community that results in injury or death to the patient and in most cases involves medical error.

Negligence on the part of a health care provider may have led to your child’s cerebral palsy. Examples of negligence that may contribute to your child’s condition are:

Failure to do a cesarean section when it is necessary
Failure to monitor dangerous fetal heart patterns
Improper use of forceps
Misreading sonograms
Misreading electronic fetal monitor strips
Improperly using vacuum extractors.

When it comes to determining if medical malpractice was the cause of your child developing cerebral palsy, it is extremely difficult for you to do this by yourself. A personal injury attorney can investigate and evaluate the details of your child’s circumstances in a way that you will not be able to do. A personal injury attorney will probably be able to determine if medical malpractice was what brought about your child’s cerebral palsy.

This is something you should not try to handle yourself. While nothing can undo the medical wrong that was done, legal compensation can help provide support if you are struggling with medical costs and cost of living concerns in the future.

It is usually the cause of much joy and celebration when a couple finds out that they are going to have a baby. On the other hand, there is a great deal of hurt, sorrow and pain that is caused by the death of a fetus.

Fetal death in the United States does not have a standard definition. In the broadest sense, fetal death is the loss of a fetus at any stage of its development. When fetal death occurs before 20 weeks’ gestation, it is usually regarded as a spontaneous abortion. When the death of a fetus takes place after 20 weeks’ gestation, it is usually considered to be a fetal death or stillbirth.

Definition of fetal death

Although it may vary from state to state, fetal death is legally defined by Black’s Law Dictionary as being, “Death prior to the complete expulsion or extraction from the mother of a product of human conception, irrespective of the duration of pregnancy and which is not an induced termination of pregnancy. The death is indicated by the fact that after the expulsion or extraction, the fetus does not breathe or show any other evidence of life, such as beating of the heart, pulsation of the umbilical cord, or definite movement of voluntary muscles.”

Fetal death may be the result of natural causes, such as unpredictable complications or genetic disorders. However, fetal death may also result from things like an error or oversight on the part of a medical worker, nurse or doctor.

Medical malpractice

If this is the case, this may be fetal death that is due to medical malpractice. According to Wikipedia, medical malpractice is defined as professional negligence by act or omission by a health care provider in which the treatment provided falls below the accepted standard of practice in the medical community and causes injury or death to the patient, with most cases involving medical error.

A medical malpractice claim for fetal death may be brought about by several things. Some of these are:

Inadequate monitoring during birth, such as failure to closely monitor things like the child and mother’s breathing and heart rate
Poor response to an emergency situation, such as dealing with sudden problems like placental abruption or hypoxia (lack of oxygen for the child)
Failure to treat or notice risk factors like gestational diabetes or high blood pressure (preeclampsia)
Womb abnormalities and disorders
Diseases and infections
Unexpected shifts of the fetus inside of the womb.

Failure on the part of a health care provider to catch and deal with these things may involve medical malpractice.
The death of an unborn child may be one of the most devastating things that you will ever experience in life. Losing that unborn child due to medical malpractice is even more devastating.

Negligent behavior on the part of a health care provider during pregnancy and/or childbirth can be the grounds for a medical malpractice claim. In order to file a medical malpractice claim for fetal death, you will need the assistance of a personal injury attorney. A personal injury attorney can help you determine if your case is legitimate and if a medical malpractice claim for fetal death is your best course of action.

If you have been injured from the negligence or malicious intent of another person you have the right to compensation for your injuries or losses. Compensatory damages are the name of damages that the court will generally award to claimants for their personal injury and they can be paid for both economic and non-economic damages. The goal of compensatory damages is to financially restore the injured party to the state they were in prior to the accident.

Compensatory damages can include payment for medical bills (future and current medical costs), payment for loss of income (current and future lost wages), payment for property damages (car, home, personal items) and payment for pain and suffering.

State laws vary and states award damages according to various laws and processes but judges and juries in states will award monetary compensation based on elements of the case, the credibility of witnesses, and the validity of the evidence.

When will I get pain and suffering payments?

Compensation for pain and suffering is only given if you can prove that that you have suffered pain and suffering (emotional or physical) from an actual injury.

For example, pain is obviously a result of any physical injury: broken bones, surgery, lacerations, bruises, disfigurement or burns. What about suffering? It obviously can be caused by injuries as well and could include psychological suffering from a severe injury or permanent disfigurement, embarrassment, post traumatic stress or humiliation.

Evaluating Pain and Suffering

The courts will evaluate a number of factors in your personal injury case to determine if you can receive pain and suffering compensation for example:

Did you seek medical care for your personal injuries? If you did not seek medical care the courts may assume you did not suffer any injuries.

Did you have permanent injuries which caused disfigurement or loss of limb?

What was the degree of pain you suffered from your injuries?

Will you need long-term medical treatment?

Are you going to be able to return to work?

Did your injuries cause significant loss of enjoyment of life?

How severe are your injuries?

Are you currently taking your prescribed medications?

Calculating my payment for pain and suffering

Unlike medical costs, property damage, lost wages or other types of compensatory damages calculating the amount you should be entitled to receive for pain and suffering can be complicated. If you have been severely injured and you are unsure of the long-term costs of your injuries, talk to a personal injury lawyer.

Punitive Damages after a Personal Injury

We have all heard of outrageous settlements awarded for personal injury cases. Most of the especially high payouts are made for what the court calls punitive damages. Punitive damages are paid by the defendant in very specific circumstances. Unlike compensatory damages, which are paid to make the defendant “whole,” punitive damages are awarded to punish the defendant for their illegal or negligent actions.

Are you entitled to punitive damages? It will depend on the laws of your state, the nature of your injuries and the actions of the defendant. Punitive damages are not allowed in all personal injury cases, and if allowed, they may be capped by state law.

Asbestos is a natural mineral product. Because asbestos is resistant to heat and corrosion, it has been a very valuable product in the field of manufacturing . Asbestos used to be heavily used in products such as cement, vinyl floor tiles, insulation and fire-retardant materials.

However, in the middle 1970s, the United States government began to regulate the use of asbestos and asbestos products. So that, at the present time, the handling and use of asbestos is under strict government regulation.

Exposure to asbestos

The reason why asbestos is under strict government regulation is that heavy, long-term exposure to asbestos before government regulation has resulted in serious lung and breathing disorders. One of these conditions is asbestosis.

Another disorder is mesothelioma. Mesothelioma is a type of cancer that almost always is brought about by exposure to asbestos. Malignant cells form in your mesothelium. Your mesothelium is a protective lining that covers most of your body’s internal organs.

Mesothelioma is divided into different forms. This is determined by the area of your mesothelium that is affected. Some of these forms are:

Pericardial mesothelioma – This affects the tissue surrounding your heart.

Pleural malignant mesothelioma – This form is the most common type of the disease and affects the tissue that surrounds your lungs.

Peritoneal mesothelioma – This kind develops in the tissue of your abdomen.

Mesothelioma of the tunica vaginalis – The lining around you testicles is where this form of mesothelioma begins.

One of the problems in diagnosing mesothelioma in its early stages is that its signs and symptoms are similar to other disorders that are not as serious. Mesothelioma is hard to treat, even when it is found in its initial stages.

The prognosis or outlook for people with mesothelioma is not good. People have an expected lifespan of less than three years when the disorder is usually diagnosed.

Personal injury claim

If you have experienced long-term exposure to asbestos, you are entitled to file a mesothelioma personal injury claim. A personal injury claim is a legal action that is brought in court by a person who has been injured in some way that is either physical or emotional by another person. In the case of mesothelioma, it may be against an individual or a company.

One of the primary questions in regard to filing a mesothelioma personal injury claim is the statute of limitations. A statute of limitations is a legal deadline that specifies how much time you have to make a claim in a legal proceeding. With a mesothelioma personal injury claim, the statute of limitations varies from state to state.

However, because mesothelioma may take decades to develop, and because the vast majority of people who have had exposure to asbestos were not told of the health risks, several states now have legislation where the time begins when the first signs and symptoms of mesothelioma begin to show up, not when you had first exposure to asbestos.

If you are thinking about filing a mesothelioma personal injury claim, it is important not to delay. You really ought to contact a personal injury lawyer as soon as possible.

Have you fallen at the grocery store? Are you wondering whether you can file a claim against the grocery store because of your fall?

Falling at the grocery story comes under the heading of what is referred to as “slip and fall” cases or claims. It is a claim or a case that is founded upon you slipping or tripping and falling.

What is a “tort”

A slip and fall claim is what is known as a “tort”. A “tort” is a civil wrong in common law jurisdictions. Common law, which is also known as precedent or case law, is law that has been developed by judges through decisions of courts, rather than through executive branch action or legislative statutes.

Tort law has to do with circumstances and situations where a person’s behavior has unfairly caused someone else to suffer harm or loss. A tort is not necessarily an illegal act. However, a tort does cause harm or loss. Because of this, the law permits anyone who suffers loss or harm to recover their loss. This is done through filing a personal injury lawsuit.

Consequently, you are allowed to file a personal injury lawsuit or claim against the grocery store for any injuries that you may have suffered when you fell. However, the important issues are, “Can I win the claim? What can I hope to recover? Will it be worth it to file a claim?”

Why did you fall?

The first thing that has to be considered is, “Why did you fall at the grocery store?” Were you being careless? Were you not watching where you were going? If this is why you fell at the grocery store, you do not have a claim or case.

On the other hand, did you fall because someone else created or is maintaining a dangerous situation. If this is why you fell, you may have a claim.

Another thing to be considered is, “Did the grocery store have a sign up that warned of the danger of a fall or to watch your step?” Even if the grocery store had a sign, it does not necessarily mean that you do not have a claim for your fall. It depends on the location of the sign and how adequate the sign was, given the condition of the floor.

How bad are your injuries

You also need to take into consideration how badly you were injured when you fell at the grocery store. If your injuries are minor cuts or bruises, you really do not have a claim against the store. On the other hand, if you hit your head when you fell and received a concussion, or you have broken bones or fractures from the fall; you may have a claim against the grocery store. If you have medical expenses that resulted from your fall at the grocery store, you may have a claim.

Laws regarding personal injury lawsuits vary from state to state. Although you can try and file a personal injury claim against the grocery store yourself, the smart thing to do is to have a personal injury lawyer working for you. A personal injury lawyer will evaluate your claim and tell you how good a case you may have against the grocery store. A personal injury lawyer will also tell you what you may be able to recover if your claim is won.

If you have ever been attacked and bitten by a dog, it is something that you will probably never forget. Being attacked and bitten by a dog may cause nightmares for the rest of your life.

What about your injuries

Have you been injured from a dog attack in Louisiana? Are your injuries serious? Are your injuries going to take a long time to recover from? Have you been scarred or disfigured as a result of being injured from a dog attack in Louisiana.?

What you would really like to know is, “Does Louisiana have a “dog bite” law? Can I be compensated for the injuries I sustained from being attacked? Is the dog owner liable for my injuries?”

No dog bite law

Louisiana does have a dog bite law. Louisiana’s dog bite law is different than dog bite laws in some other states.

The State of Louisiana is what is referred to as a strict liability state. There are other states that have what is called a “one bite rule”. What this does, generally speaking, is to grant the owner of the dog what you might think of as “one free bite” for his dog.

In Louisiana, however, if you have been injured from a dog attack, you must prove that the attack could have been avoided by the dog owner. The dog owner is responsible for any injuries that the bite of his dog causes if the dog owner is proven to be negligent. In other words, dogs in Louisiana do not get one free bite.

You may would like to talk to a personal injury lawyer about filing a claim because you were injured from a dog attack in Louisiana. Before you do, you need to know that there are some things that may prevent you from filing a dog bite claim. Some of these include:

If you were on someone else’s property unlawfully
If it was a police dog doing military work
If you were provoking or harassing the dog.

If none of the above are true and you believe the dog attack could have been prevented by the dog owner, you may need to talk to a personal injury lawyer. They can help you get the compensation that is rightfully yours for being injured from a dog attack in Louisiana.

More than physical injuries

As mentioned at the beginning, being attacked by a dog is something that may leave you with a lifetime phobia. Injuries from a dog attack in Louisiana may not only result in serious physical injuries, it may also cause you deep and abiding psychological and emotional trauma.

In Louisiana, you may be compensated for things like disability that is brought about by the dog attack, scarring or disfigurement, suffering and pain, income that you lose because of missing work and your medical bills. However, in order to receive adequate compensation for being attacked by a dog in Louisiana, you will need the representation of a personal injury lawyer.

Do not wait. Louisiana does have a statute of limitations. Call, today.
