Manny Ramirez Arrested after allegedly slapping wife

Former World Series MVP Manny Ramirez was released from a Broward jail on Tuesday morning, September 13th. He was arrested for allegedly slapping his wife in their South Florida home.

Ramirez, 39, had his bond set at $2,500 during a court appearance before Judge John Hurley. The judge also ordered the former baseball star to stay away from his wife, Juliana Ramirez.

According to Broward County sheriff’s officials, both Ramirez and his wife were having an argument in their home on Monday afternoon when Manny slapped his wife across the face, causing her to fall back and hit her head on their headboard. She told the sheriff that she was afraid the situation might escalate, so she called police.

In the 911 call released by the police, Juliana Ramirez tells the operator, “Hi, my husband just hit me.” When the operator asked her where she was hit, Juliana responded, “My face, my head in the bed, I have a bump on my head.”

“Are you in a room that you can stay away from him?” the operator asks.

“No, he’s not doing anything more because he knows I’m calling police,” she replies.

When officers arrived, Ramirez told them that his wife hit her head after he grabbed her by the shoulders and ‘shrugged’ her, the report stated.

The report went on to say there was red swelling evident on the left side of Juliana’s face, and that there was a contusion on the back of her head which was consistent with her version of events.

One of baseball’s great sluggers, Manny Ramirez, born in the Dominican Republic, began his career with the Cleveland Indians. He was later traded to the Boston Red Sox where he became a superstar. While there, Ramirez won two World Series and was named MVP of the 2004 Series. The Red Sox traded him to the Los Angeles Dodgers in 2008 where he was an instant fan favorite. He led the Dodgers to the National League Title and a sweep of the Chicago Cubs. His clutch hitting earned Manny a two-year, 45 million dollar contract.

Everything came crashing down when Ramirez was suspended fifty games by MLB for violating the league’s drug policy in 2009. He was traded to the Tampa Bay Rays where he retired in April 2011, after testing positive a second time for a performance-enhancing substance. The twelve time All-Star chose to retire instead of facing a 100 game suspension.

After posting the bond, Ramirez walked out of jail, speaking mostly in Spanish. “That’s a closed case,” Ramirez said. “I am the protagonist and I closed it.” When a reporter asked Ramirez to ‘give them something’, he replied “Not my problem.”

Ramirez got into an SUV driven by his sister. She stated, “He’s my brother and we love him no matter what.”

Who is responsible for the cost of my injuries from a bar fight?

According to MNDaily.com, a group of mean assaulted two customers at The Library Bar and Grill in Minnesota early Monday morning. One of the assaulted men is in the hospital.

A friend of the victim saw his friend, Justin Griesinger, on the ground surrounded by a large group of men as he was leaving the bar for the night and he quickly came to his friend’s defense.

“I was just walking out to go to a different bar … and I just saw my buddy just getting the crap kicked out of him,” Walsh said. “I’d never met the kids … there was like 12 of them.”

Walsh remembered little after attempting to stop the assault, “About the last thing I can remember, I was running over and I got just absolutely knocked out cold,” Walsh said. “The next thing I remember is waking up by the police officers.”

Griesinger also claims that he did not know the attackers and did not understand why he was the first one attacked.

Sgt. Bill Palmer of the Minneapolis police force said that only one of the suspects in the assault has been arrested.

Griesinger has sustained a broken nose and head injury which required stitches. Evidence of the fight can still be seen on him. “There’s about 15 footprints on my chest right now and on my back from their feet stomping on me when I was out cold,” he said.

The arrested suspect was taken to Hennepin County Jail and booked for third-degree assault. He remains in custody. The investigation is ongoing.

According to Walsh there seems to be more suspects who have not been arrested. “My one roommate picked me up and carried me away when I was knocked out cold,” Walsh said. “My friends were just trying to get to us and they couldn’t even do it.”

Filing a Personal Injury Claim for Injuries Sustained at a Bar Fight

Although attacks at bars are relatively rare, if you have been injured at a bar you may have severe injuries which may lead to expensive medical bills. You may be wondering who is going to pay for your injuries. Is there someone you can hold responsible for the damages you have suffered?

One of the common questions is can you hold the bar responsible for the injuries. It is important to talk to a personal injury lawyer about your case but in general unless the individual who punched you is an employee of the bar, the owner of the bar or the bar had prior warning of the impending attack, you may not have a case against the bar.

In fact, the bar owner might have to specifically state that they are assuming the liability of protecting the customers to be held liable for the attack and the cost of the injuries.

Who is liable for your Personal Injuries after a bar fight?

So the next question might be: who is responsible for your personal injuries? If you have been injured by the negligent or criminal actions of another person you may be able to file a civil claim against the person who attacked you.

Keep in mind the aggressor in the attack does not have to be charged or convicted of a crime to be held liable for your personal injuries.

All states have statute of limitations for filing personal injury cases. Talk to a personal injury lawyer who is familiar with the laws of your state to make sure you file your claim prior to the expiration of the statute of limitations.

States also allocate compensation from a civil claim using various methods. In some state the courts must find you less than 50% at-fault for the incident for you to recover compensation. Other states do not award any compensation if you are found to be at fault at all for your injuries. Other states will allocate damages according to the defendants and plaintiffs percentage of guilt.

Hiring a personal Injury Lawyer

To win a personal injury claim, the injured party generally has to prove negligence (exceptions exist for product liability claims and workers compensation claims). If you have been injured from the negligence of another person, specific procedures must be followed. Gathering evidence, preserving evidence, and gathering witness and expert testimony may be crucial to proving your injury claim.

Personal injury lawyers have the expertise to help you calculate the amount of compensation you may be entitled to receive for your claim. Many personal injury lawyers work on a contingency fee basis and may not be paid until you are awarded compensation.

Man beaten and run over in Jackson, Mississippi, due to possible hate crime

CNN reports that the family of James Craig Anderson, 48, who was killed early June 26 in Jackson, Mississippi, has filed a wrongful death suit after Anderson was beaten and run over with a truck.

The wrongful death claim, which was filed Tuesday in a Mississippi district court, claims there were seven white teens who instigated the attack after they decided to “set out on a mission” to find and harass African-Americans.

The lawsuit is seeking a jury trial and damages. It was filed by the victim’s sister, mother and two brothers, and names several teens in the suit, even two teens who acted as lookouts while other teens allegedly carried out the crime.

“James Anderson lost his life for no other reason than the color of his skin,” said Morris Dees, chief trial counsel for the Montgomery, Alabama-based Southern Poverty Law Center, in a statement. “Those responsible must be held accountable for their callous and deadly actions. We are filing this lawsuit today to ensure his family gets a measure of justice.”

This wrongful death suit is brought in conjunction with criminal charges which have been brought against Deryl Dedmon Jr., 19, of Brandon, Mississippi, who has been arrested on capital murder and John Aaron Rice, 18, who has been charged with simple assault after a judge reduced the original charge of murder.

Other teens who may have taken part in the killing and have been named in the wrongful death suit include Sarah Graves, Shelbie Richards, William Kirk Montgomery, John Blaylock and Dylan Butler. None of the teens have been arrested or charged with a crime.

The United States Department of Justice has sent investigators to Jackson to investigate the killing as a possible federal hate crime. They are assisting local prosecutors and determining if additional federal charges should be brought against the teens.

For now the civil case will be prosecuted at the same time as the criminal case, but the attorneys for defendants may eventually file motions to ask the court to stay the suit pending the outcome of the criminal trial.

Filing a Wrongful Death Lawsuit

If someone else’s criminal or negligent actions have contributed or caused the death of a family member, you may be entitled to compensation for your loss. All personal injury or wrongful death claims have a statute of limitations which determines the length of time you have to file your claim.

Wrongful death laws vary by state. Contact a personal injury lawyer to find out how long you have to file your claim.

Hiring a Personal Injury Lawyer

If someone you love has been injured or killed from the negligence of another person or party, it is time to talk to a personal injury lawyer.

Personal injury lawyers understand the complexities of personal injury law and can review your evidence, hire experts to give testimony for your case and ensure your legal rights are protected.

Injury lawyers generally work on a contingency fee basis and will only be paid if you win your wrongful death claim.

Florida A&M women’s basketball player, Shannon Washington, stabbed to death

Shannon Washington, a Florida A&M women’s basketball player, died early Sunday morning after being stabbed in the neck by a friend in her apartment during an argument. Florida police have charged her friend with first-degree murder.

The friend, Starquineshia Palmer, was visiting Washington this weekend and was in the apartment when Tallahassee, Florida, officer arrived on the scene at 2 a.m. Washington was taken to Memorial Hospital in Tallahassee after receiving medical care at the scene, according to police officials.

Washington had transferred from Illinois Valley Community College to FAMU and was set to play her first season. Last year she was considered one of the top JUCO guards in the nation.

”Our hearts and prayers go out to Shannon’s family and members of the Lady Rattlers Basketball Team,” FAMU President James H. Ammons said in a statement. “For Shannon to be killed in the prime of her life is tragic and senseless. She had so much promise as a student athlete.”

A vigil is scheduled Sunday night in Washington’s honor. FAMU also plans to have grief counselors available to meet with FAMU students, athletes and coaches.

“It is truly a trying situation to lose a student-athlete that has come to us to further her education and excel at her sport,” FAMU women’s basketball coach LeDawn Gibson said. “As a coach, this is the kind of incident you just hope you never have to deal with – the death of one of your players at such a young age.”

Shannon Washington was from Sarasota, Florida. She helped the Eagles team reach the national junior college tournament for both of the seasons she was with the team.

Athletes throughout the women’s basketball community have mourned the loss of this young woman and her promising career.

Hiring a Personal Injury Lawyer

If you have been injured by the criminal or negligent actions of another person, contact a personal injury lawyer and find out how you can get compensation for your losses. If someone you love has been killed, like Shannon Washington, the surviving family members of the victim may receive compensation for their loss.

Given the variety of injuries that can be caused by a personal injury, it is important to find a personal injury lawyer who specializes in a particular type of personal injury case.

Bat attack at Minnesota Wal-Mart

A trip to a Wal-Mart in Cambridge, Minnesota, turned into a perilous outing for a five year-old girl and her mother when the little girl was attacked by a rabid bat while shopping in the frozen foods section. Zoe Zachrison would normally be enjoying her final days of summer, instead she is undergoing a series of three shots to prevent rabies.

“She is traumatized,” said Holly Townley, Zoe’s mother. “She was sitting in the child part of the cart, minding her own business,” said Townley. They began walking down the frozen pizza section of the Wal-Mart when “the bat flew down the aisle, flew back at us, flew down and landed on her, attacking her and biting her leg.”

Doctors do not know for sure if the bat was rabid, but they are assuming that it is because bats do not generally bite.

Her left leg still has a mark on it from the bite. On her other leg are marks from the rabies’ shots. The attack itself was disturbing, but the rabies’ treatments and side effects are causing even more trouble. “She had a 103 degree temperature, very achy and sore joints – almost as if she were a ninety year-old man,” said Townley. Zoe has been to the emergency room three times since the incident, and Wal-Mart has reportedly refused to help pay for any medical bills.

Walmart Responds to Injury

Dianna Gee, Senior Manager for Media Relations at Wal-Mart, says that the store has a claims process to handle incidents that happen in their stores. “We hired a pest management company but have never had a problem with bats at that store. Management at that store is very concerned about that little girl,” said Gee. “It’s an unusual and unfortunate incident.”

“I think Wal-Mart needs to step up and take responsibility for what happened to her. This was their store and this is their responsibility,” said Holly. She is ready to file a personal injury lawsuit, but right now her focus is on helping her little girl recover. “She’s scared. She refuses to go into stores; she doesn’t want to leave the house.” Holly also says that Wal-Mart claimed that they are not responsible for any costs that arise from the bat attack.

Personal Injury Lawsuits

Although the party who felt endangered and injured by Wal-Mart will most likely file a personal injury lawsuit, success of that endeavor is all too often dependent upon the quality of legal representation and the jury that is involved.

If you feel that you have been injured by the negligent actions of a business, the first thing you must prove is that the business failed in its duty to act with reasonable care for the safety of its’ customers. To prove this negligence, the plaintiff must show that the defendant first owed a responsibility to the plaintiff, that obligation was violated, and that the acts of the defendant (or business) were the cause of the plaintiff’s resulting damages which could have been avoided if the business had not been negligent.

Hiring a Personal Injury Lawyer

While there is always the possibility that this case involving Wal-Mart and little Zoe will proceed to civil court, it is important to note that the majority of personal injury claims are resolved with an out-of-court settlement.

If you or a family member has been injured and you seek advice concerning your situation, please contact a qualified personal injury lawyer who can help put you on the path to recovery.

Lost Star Matthew Fox allegedly assaults bus driver

TMZ reports that Matthew Fox, best known of his role on Lost, was arrested early Monday Morning after allegedly punching a woman after attempting to board a Cleveland bus. The woman, a bus driver, was injured after telling Fox that he could not board the party bus because he was intoxicated and he was not on the guest list.

Fox punched the driver in the stomach and the chest, but the woman retaliated punching Fox in the mouth. Reports indicate that the driver did not suffer serious injury, although she did have to seek medical attention for her injured hand.
An off-duty police officer was at the scene and Fox was handcuffed, questioned by police but later released without being formally charged with assault and battery.

The driver has made statements since the altercation that she does not plan to allow Fox to “get away” with anything, regardless of whether or not he is a celebrity.

Filing a Personal Injury Claim

We do not know yet whether this woman has decided to file a personal injury claim or whether the story is accurate but individuals who have been injured by the negligent or illegal actions of another person may be able to file a personal injury claim and receive compensation for their personal injuries. More common personal injuries include: car accidents, construction site accidents, medical malpractice claims, dog bites, wrongful death cases, and motorcycle accidents.

Personal injuries can happen at any time. If you have been injured in a personal injury, taking immediate action can ensure that you do not lose the opportunity to file an injury claim and receive compensation or payment for your loss.

Keep in mind, regardless of whether or not Matthew Fox is ever found guilty of assault and battery at a criminal trial, the driver in this incident may be able to file a civil claim and receive compensation for any injuries she has suffered. Civil claims generally do not require as high a burden of proof as a criminal charge.

How much is a personal injury claim worth?

If you have been the victim of the negligent or reckless actions of another person and you have suffered either physical or emotional harm, you may be entitled to file a personal injury claim against that person and recover damages for the following:

• Past, current and future medical costs
• Past and future lost income
• Property damage
• Cost of hiring help to perform tasks that you are no longer able to perform
• Permanent disfigurement or disability expenses
• Pain and suffering
• Any other costs directly related to your injury

Hiring a Personal Injury Lawyer

Every state has a statute of limitations for filing personal injury claims. Failure to file a personal injury claim within the statute of limitations can eliminate a claimant’s right to compensation.

Due to the variances in state laws regarding personal injury, it is always a good idea to contact a personal injury lawyer in your state who is familiar with filing a personal injury claim.

Personal Injury Lawsuit for Hit and Run

Devin Byrd, a twelve year-old resident of Richardson, Texas, was riding in a go-kart on the sidewalk at Heights Park last month when a woman driving an SUV jumped the curb and struck the boy.

Elaine Burbridge, the 62 year-old driver of the SUV, left the scene without stopping to render aid. Eyewitnesses saw the SUV crash into the go-kart, make a U-turn and leave the area. Police later found a vehicle matching the witnesses descriptions in a neighborhood near the park.

Burbridge claims she did not remember an accident, but she has contacted an attorney. She turned herself in several days later and was released on $5,000 bond.

Police stated that Burbridge left the area without getting out of her car to see if the boy she hit was okay or needed medical attention. She is charged with failure to stop and render aid. Burbridge’s attorney does not refute the fact that she was involved in the collision, but he claims she has an undiagnosed seizure disorder which caused her to temporarily black out and crash into the boy.

“I think that’s offensive to anybody that has common sense,” said Courtney Hopping, a spokesperson for the family. Hopping continued, “You should be able to play in the park without being rundown and left for dead.”

The boy’s family is disappointed about the charges assessed against Elaine Burbridge. She has been charged with failing to stop and render aid, which is a third-degree felony. This charge also carries a ten year prison term and $10,000 fine. They believe she should be charged with a harsher second-degree aggravated assault felony which could extend her prison term to twenty years.

Devin Byrd remains in the Children’s Medical Center in serious condition and is not able to breathe on his own. His family members say he has good days and are hopeful that he will begin to steadily improve.

Richardson police say they will not file any additional charges before they conclude their investigation. The driver’s family said that they noticed Burbridge “blanking out” on several occasions within the last three months. A neurologist has instructed her not to drive until her condition is clarified.

Rebecca Herrell, a nearby neighbor is irritated with Burbridge’s defense. She was driving by the park and saw the accident occur. “It was very obvious that she stepped on the gas and was trying to get out of there,” Herrell said.

Whether or not Burbridge’s neurological condition exists will be determined by the courts. Byrd’s family is focused on his recovery but will soon face the bills that accompany serious accidents, not to mention the months of recovery and recuperation for young Devin.

Summer of Bear Attacks Continues

Two boys, one 11 year-old from Brooklyn and a 12 year-old from Jersey City, New Jersey, were attacked by a young black bear while they were camping in New Jersey on Wednesday, August 3rd. This incident is the latest in several bear maulings that have occurred this summer. The attack happened just prior to daybreak in Stokes State Forest in the northwestern part of the state.

Larry Ragonese, spokesman for the New Jersey Department of Environmental Protection said, “Our best assumption is that the bear smelled food and went into the tent following the scent and encountered people and was a bit more aggressive than you would normally expect.” He went on to say that “more and more, bears are looking for food and they’ll break through sliding doors or windows.”

The boys were treated for minor injuries at a local hospital and were released after several hours to rejoin the other young people at the camp.

Series of Bear Attacks Around Country

In July, seven teens were attacked by a grizzly bear in Alaska while they were on a survival hike in a National Park. They were all able to escape fatal injuries. On the other hand, a hiker was killed in Yellowstone National Park by a female grizzly bear who had two cubs with her. Also last month, a woman in Arizona was killed by a male black bear who was rummaging through a dumpster at a country club.

Riel Peerbooms, executive director of the camp where the two young boys were attacked said that both campers and counselors are schooled in what to do should there be a bear attack. “They were trained to move away and to make a lot of noise,” he said. “During the incident, a counselor blew a whistle and the campers broke in song and clapped. The bear took off.”

This reaction may have saved the boys from more severe injuries. The young bear did run off, but he came back to look for food. He was then shot in the neck by a state conservation official. The wounded bear ran into the woods and is now being tracked by conservation workers. Hiking trails in the State Park were closed as were sections of the Appalachian Trail until they can find the bear.

The Legal Side

One decision families face after a wild animal attack is to investigate their legal options. Depending on the severity of the episode, emotional turmoil can sometimes cause families of attack victims to want to hold someone accountable for that attack. They may hope that they can find closure to a lamentable incident in their lives.

In the past, lawsuits that seek to hold someone or something accountable for wild animal attacks have not been too successful…until now. In a 2011 case, a family who lost their child to a bear attack in 2007 sued the U.S. Forest Service. The lawsuit claimed that in the time before the fatal attack, the Forest Service did not inform campers of an earlier bear attack. Both attacks took place at the same campsite and were perpetrated by the same bear. The family maintained that if they were notified of the prior attack and that an aggressive bear was in the area, that information would have made them make different choices that could have saved their child’s life.

The District Judge that heard the case decided that the U.S. Forest Service was partially negligent and awarded 1.9 million dollars to the family of the deceased child. While this decision could open the door for future lawsuits involving wild animal attacks, the judge also added restrictions. Claims resulting from these attacks can only be legitimate and sensible if the animal had attacked a second time in the same vicinity of the first and within 12 hours of the previous attack.

Honda Recalls 1.5 Million Vehicles

According to the Associated Press, Honda is recalling more than 1.5 million vehicles throughout the United States to make updates to the software on the automatic transmissions systems; changes Honda hopes will decrease the likelihood of transmission damage.

What will happen if the changes are not made? Honda claims that failure to make the modifications may result in the damage to the transmission’s secondary shaft bearing, if the car is shifted to quickly. This most often occurs when a driver attempts to get a vehicle out of snow or mud.

Recalls affect the 2005-2010 4-cylinder Accord, 2007-2010 CR-V and 2005-2008 Element vehicles and notices will be sent beginning August 31, 2011.

Although the company confirms that there have been no deaths or injuries from the automatic transmission problem, the company has chosen to proactively deal with the issue.

Common Product Liability Claims

It is not uncommon for car or product manufacturers to proactively recall products to avoid the potential legal fees that may result if a consumer is injured by a defective product. In the past years there have been a high number of product liability claims which have been caused by defective products. Some of the most common product liability claims have been caused by the following product defects:

• Tire blowouts
• SUV instability due to poor design
• Improper airbag design
• Insufficiently supported roofs
• Defective seatbelts
• Improper fuel tank design

Types of Product Liability Claims Involving Motor Vehicles

The complexity of designing and producing motor vehicles can result in defective products. Product liability claims are generally filed due to a product or part which was defectively manufactured or a defective or dangerous design. Defective manufacturing of a product can occur if a product was improperly manufactured at the factory.

Products which injure consumers due to a defective design were generally manufactured according to the specified design, but that design was inherently flawed or unsafe. Products with a defective design may make it to market and be in use by many consumers.

Filing a Product Liability Lawsuit

Product recalls have cost car makers millions of dollars. Companies have increasingly recalled defective products rather than waiting until a consumer is injured or killed. If you have been injured from a defective product, you may be able to win compensation without proving that the company was negligently responsible for your injuries. Personal injury lawyer who are familiar with product liability claims can review your claim and find out if you have a product liability claim.

Keep in mind there may be a statute of limitations for filing certain types of personal injury claims. Waiting too long may eliminate your right to compensation.

“Cash Cab” Hits and Kills Pedestrian

According to the Associated Press a pedestrian was hit and killed in Vancouver, Canada, Friday night after filming had finished for the television game show “Cash Cab.”  These types of pedestrian accidents are not that uncommon.

The unidentified 61 year-old man died after being struck by a “fake” taxi cab. The President of the show’s production company, Andrew Burnstein, said the producer of the show was driving the taxi back to a storage facility when the accident occurred.

“Cash Cab” is a broadcast on the Discovery Chanel in North America. The goal of the game show is to help contestants win money answering trivia questions as the replica yellow taxi takes people to their destination.

Personal Injury Claims after a Car Accident

Car accidents kill close to 40,000 people every year in the United States (according to the National Highway Traffic and Safety Association (NHTSA)), and unfortunately, they are the leading cause of death for individuals 2 to 34 years old. Car accidents also cost insurance companies billions of dollars each year.

Personal injuries from a car accident may be caused by the illegal or negligent actions of another driver. Whether you are injured as a pedestrian or you were driving a motorcycle, bicycle or car, if your accident was caused by the negligent actions of another driver and you have suffered loss, you may be able to file a personal injury after your car accident and win compensation.

Common Car Accident Injuries

What are the most common types of car accident injuries? It not unusual for the injured to suffer from any of the following: knee damage, head trauma, neck injury, back injuries, spinal cord injuries or whiplash.

The most important thing after a car accident is to seek medical attention. Document your car accident injuries. Take pictures. It is not uncommon for some injuries to manifest several hours or days after the car accident. Whip lash, one of the most common injuries, may not be noticeable right after the accident but several hours or days later.

Many states will only let you file a personal injury claim if your car accident injuries reach a certain dollar or a severity thresh hold. Talk to a car accident lawyer and find out your rights.

Hiring a Car accident Lawyer

Car accident lawyers can review the laws of your state and let you know if you have a personal injury claim. Most car accident claims will be negotiated with an insurance company, and car accident lawyers can make sure you get enough compensation for your injuries to pay for you pain and suffering, lost wages and medical bills.

Car accidents are frequently caused by hit and runs, driving while intoxicated, semi-trucks, uninsured motorists and dangerous construction sites. Do not settle with the insurance company before calculating the full cost of your car accident injuries.

Car accident lawyers understand accident and personal injury law. Whether you are filing an insurance claim or filing a car accident lawsuit, a car accident lawyer can help prove fault and collect the damages you need. Hiring a car accident lawyer for personal injuries caused by a car accident may become even more important for injuries which require hospitalization or which cause permanent and severe personal injury.
