Workers' Compensation Exclusions

If your Workers' Compensation claim is denied or is not covered under your employers Workers' Compensation plan you may be able to file a personal injury lawsuit.

Workers' Compensation may not cover the following cases:

  • If a an intentional act by a co-worker caused your injury (ex. an assault)
  • Your employer did not have Workers' Compensation insurance
  • You were an independent contractor
  • Company policy was being violated

In addition, state courts have not always ruled consistently on injuries sustained at work while " playing around ", intentionally injuring yourself or if you were intoxicated and injured yourself. Travel injuries also have not generally been covered unless you are being provided transportation and travelling is a job requirement.

Compensation may be denied if an employee left the premises and was injured. If an employee is injured while engaging in other personal activities such as restroom, smoking, or lunch breaks the courts often have awarded compensation.
