Do I have a wrongful death lawsuit?
In order to have a wrongful death claim the following must be true:
- The defendant's actions in part or in whole caused the death. This can be with or without the intention of injuring or killing the victim.
- The defendant was negligent or liable for the death.
- There are surviving family members who have lost income or suffered emotional distress as a direct result of the death.
Who can file a wrongful death case?
In most states immediate family members may file a wrongful death lawsuit. In some states potential plaintiffs have been expanded to include grandparents, legal dependents and other extended family members. If a minor is eligible to file a wrongful death claim he may need to be represented in court by a guardian.
