Do I have a wrongful death lawsuit?

In order to have a wrongful death claim the following must be true:

  1. The defendant's actions in part or in whole caused the death. This can be with or without the intention of injuring or killing the victim.
  2. The defendant was negligent or liable for the death.
  3. There are surviving family members who have lost income or suffered emotional distress as a direct result of the death.

Who can file a wrongful death case?

In most states immediate family members may file a wrongful death lawsuit. In some states potential plaintiffs have been expanded to include grandparents, legal dependents and other extended family members. If a minor is eligible to file a wrongful death claim he may need to be represented in court by a guardian.
