Severe Injuries Caused by Care Center Abuse
When you place your loved one in a care center, you have a right to expect that your loved one is going to receive the loving care that they need and require. You have a right to expect that your loved one will be treated with kindness, dignity and respect. You certainly do not think that your loved one will be abused by the very place that is supposed to be taking care of them.
However, a Florida care center, the Florida Institute of Neurologic Rehabilitation (FINR) has been accused of care center abuse. It is alleged that this care center is guilty of abuse that has brought about severe injuries.
In October, 2012, a local advocacy group, Disability Rights Florida, filed a lawsuit against the Florida Institute of Neurologic Rehabilitation. The lawsuit alleges that staff at the care center did not allow an investigator to speak to witnesses during the time of an investigation. That particular investigation was centered on claims that a patient had been abused by staff at the care center.
Already lost abuse lawsuit
This care center has already lost a care center abuse lawsuit. It was a $5 million wrongful death lawsuit. Now, additional accusations of care center abuse have been brought forth.
The Florida Institute of Neurologic Rehabilitation is a care center that treats patients who have brain injuries. In addition to the $5 million wrongful death lawsuit which it lost, the care center is now up against a lawsuit that was filed by Allstate Insurance. This lawsuit claims that patients have been abused and beaten by staff at the care center. In addition, it alleges that patients have been forced to stay in the care center for a longer period of time than was necessary.
An investigation has been started regarding allegations that patients have been abused by staff of the care center. It is alleged that death resulted in some of these instances. An undercover tape supposedly reveals two staff members elbowing a patient in the chest who had brain injuries. Another patient was allegedly given solid food when they had been restricted to a liquid diet. The food is alleged to have aspirated in the patients lungs, which resulted in the patients death.
Wrongful death lawsuit
In another incident, a patient died after he was taken down by four staff members at the care center. Even though this mans family won the $5 million wrongful death lawsuit against the care center, and the mans death was ruled a homicide; no criminal charges were ever filed against any of the care centers staff.
In response to the allegations, a spokesperson for the Florida Institute of Neurologic Rehabilitation said that any abuses against patients which took place at the care center were the actions of individual staff members. The spokesperson said that they were not caused by procedures or policies of the care center.
